These Terms and Conditions govern your access to and use of the Peak Operator website, software platform, webinar pages, checkout pages, events, Mastermind sessions, services, content, tools, and related offerings.
By visiting our website, registering for a webinar, purchasing Peak Operator, attending a Peak Operator event, creating an account, or using the platform, you agree to these Terms and Conditions.
1. Overview of Peak Operator
Peak Operator is an AI-powered operating system built specifically for multifamily syndicators. The platform is designed to support acquisitions, underwriting, capital raising, investor relationship management, KPI tracking, operations, CRM workflows, and related business processes.
Peak Operator may include AI agents, CRM functionality, underwriting tools, workflow tools, investor pipeline tools, team KPI tools, content systems, event access, onboarding, training, and implementation support.
2. Eligibility
You must be at least 18 years old and legally able to enter into binding agreements to use Peak Operator.
By using our website, purchasing our services, or creating an account, you represent that you have authority to agree to these Terms on behalf of yourself or the business entity you represent.
3. Accounts and Access
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
You agree not to:
- Share login credentials with unauthorized users
- Allow unauthorized access to your account
- Misrepresent your identity or business
- Attempt to access another customer’s data
- Interfere with platform security
- Reverse engineer, copy, scrape, or misuse the platform
- Use Peak Operator for unlawful, misleading, fraudulent, or abusive purposes
We may suspend or terminate access if we believe your account has been compromised, misused, or used in violation of these Terms.
4. Products, Services, and Platform Features
Peak Operator may include:
- Peak Underwriting Agent
- Peak Operator Agent
- Peak Capital Raising Agent
- Deal pipeline tools
- KPI scorecard tools
- Investor CRM tools
- Investor messaging tools
- Buy box configuration
- Market research support
- White-label CRM setup
- Platform onboarding
- Launch Mastermind access
- Recordings, templates, workflows, and related resources
Some features may be live immediately, while others may be released later. Future features, including additional AI agents, may be subject to development timelines, technical limitations, release sequencing, and operational changes.
We may improve, update, modify, replace, or discontinue features at any time.
5. Founding Member Offer
The Founding Member offer may include a one-time setup investment, recurring platform access, Mastermind access, platform setup, AI agent configuration, CRM setup, data migration support, buy box configuration, investor messaging support, recordings, private community access, roadmap voting, and related benefits.
Founding Member pricing, benefits, and availability are limited and may not be offered again.
Founding Member rates are non-transferable and apply only to the purchaser or business account approved by Peak Operator.
6. Pricing and Billing
Peak Operator pricing may include:
- A one-time setup fee
- Monthly subscription billing
- Annual prepaid subscription billing
- Additional user fees
- Upgrade fees
- Optional service fees
- Taxes, if applicable
By submitting payment information, you authorize us and our payment processors to charge the applicable fees according to the plan selected at checkout.
For the Founding Member offer, the listed recurring options are:
- Annual Prepay: $4,164 for 12 months, equivalent to $347/month
- Monthly Plan: $497/month
- Included users: 7 user accounts
- Additional users: $50/month or $500/year if annual prepay

7. Subscription Terms and Cancellation
Monthly subscriptions renew automatically each month unless canceled.
Annual prepaid subscriptions cover a 12-month period and do not renew unless renewed according to the applicable checkout or account terms.
Monthly customers may cancel future billing at any time. Cancellation stops future recurring charges but does not create a refund for amounts already paid.
Annual prepaid customers may choose not to renew at the end of the annual term. Annual prepaid amounts are non-refundable.

8. Refund Policy
Refunds are governed by the Peak Operator Refund Policy.
Unless expressly stated in the Refund Policy, all fees are non-refundable.
The 90-day setup-fee refund applies only under the specific conditions stated in the Refund Policy. Recurring subscription fees are non-refundable.
9. Mastermind and Event Access
Certain purchases may include access to the Peak Operator Launch Mastermind or other events.
The Peak Operator Launch Mastermind is designed as an implementation event where the Peak team helps configure your operating system, CRM, AI agents, buy box, investor messaging, pipeline, KPI scorecards, and related systems.
Event dates, schedules, presenters, format, access links, recordings, and deliverables may be adjusted if necessary.
If you cannot attend live, recordings may be provided when available. Live attendance is strongly encouraged because implementation, interaction, and Q&A may be part of the event experience.
10. Customer Responsibilities
You are responsible for:
- Providing accurate account, billing, and business information
- Reviewing all platform outputs before using them
- Verifying underwriting assumptions, deal data, market data, investor communications, and financial calculations
- Maintaining compliance with securities laws, advertising rules, privacy laws, and other laws applicable to your business
- Obtaining permissions before uploading third-party data
- Managing your team’s access and user permissions
- Backing up important business data as appropriate
- Using the platform in a lawful and responsible manner
11. No Investment, Legal, Tax, or Financial Advice
Peak Operator is a software platform, not investment advice.
All underwriting, market analysis, investor communications, KPI recommendations, deal recommendations, and AI-generated outputs require operator review and verification.
Peak Operator does not provide legal, tax, accounting, investment, securities, broker-dealer, or financial advisory services.
Past performance of Axxis Capital, Peak Multifamily, Tyler Deveraux, or any related business does not guarantee future results.
Peak Operator does not guarantee that you will close deals, raise capital, generate returns, improve performance, save money, or achieve any specific business outcome.
12. AI Outputs and Accuracy
Peak Operator may use artificial intelligence to generate summaries, recommendations, drafts, calculations, analyses, workflows, and operational suggestions.
AI outputs may be incomplete, inaccurate, outdated, or inappropriate for your specific circumstances.
You are solely responsible for reviewing, verifying, approving, editing, and deciding whether to use any AI-generated output.
Do not rely on AI outputs as the sole basis for investment decisions, underwriting decisions, investor communications, legal decisions, tax decisions, or financial decisions.
13. Customer Data
You retain ownership of the business data, documents, and content you upload or enter into Peak Operator.
You grant Peak Operator the right to process, store, transmit, analyze, display, and use your data as necessary to provide the platform, services, support, security, analytics, and product improvements.
You are responsible for ensuring that you have the rights and permissions needed to upload or submit any data to the platform.
14. Intellectual Property
Peak Operator, including its software, workflows, AI agents, user interface, branding, content, copy, systems, templates, training materials, videos, documentation, graphics, processes, methods, and related materials, is owned by Peak Operator, Peak Multifamily, or its licensors.
You may not copy, resell, sublicense, distribute, modify, reverse engineer, or create derivative works from Peak Operator materials unless expressly authorized in writing.
Purchasing Peak Operator gives you a limited, non-exclusive, non-transferable right to use the platform and included materials for your own internal business purposes.
15. Acceptable Use
You agree not to use Peak Operator to:
- Violate any law or regulation
- Mislead investors or prospects
- Make false or deceptive claims
- Send spam or unlawful marketing messages
- Upload malware, harmful code, or illegal content
- Infringe intellectual property rights
- Violate privacy rights
- Attempt to bypass security controls
- Scrape, copy, or extract platform data without authorization
- Interfere with platform functionality
- Use the platform to build a competing product or service
16. Third-Party Tools and Integrations
Peak Operator may use or integrate with third-party tools, including payment processors, CRM platforms, hosting providers, analytics tools, advertising platforms, video platforms, communication tools, AI providers, or other service providers.
We are not responsible for third-party outages, errors, pricing changes, policies, security incidents, or service limitations.
Your use of third-party tools may be governed by their own terms and privacy policies.
17. Platform Availability
We aim to provide reliable access to Peak Operator, but we do not guarantee uninterrupted or error-free operation.
Access may be affected by maintenance, updates, outages, third-party service interruptions, security issues, internet disruptions, or events outside our control.
We may modify, suspend, or limit access when needed for maintenance, security, legal compliance, or operational reasons.
18. Results Disclaimer
Any statements about cost savings, time savings, underwriting speed, business efficiency, operational improvement, capital raising, deal pipeline performance, or software replacement are estimates, examples, or illustrative comparisons.
Actual results depend on your business, team, data quality, usage, market conditions, investor relationships, compliance obligations, and execution.
Peak Operator is designed to help improve operational systems, but results are not guaranteed.
19. Limitation of Liability
To the maximum extent permitted by law, Peak Operator and its owners, officers, employees, contractors, affiliates, service providers, and partners will not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages, including lost profits, lost revenue, lost data, lost opportunities, business interruption, investment losses, or reputational harm.
To the maximum extent permitted by law, our total liability for any claim related to the website, platform, services, events, or these Terms will not exceed the amount you paid to Peak Operator during the three months before the claim arose.
20. Indemnification
You agree to defend, indemnify, and hold harmless Peak Operator, Peak Multifamily, their owners, officers, employees, contractors, affiliates, partners, and service providers from claims, damages, liabilities, losses, costs, and expenses arising from:
- Your use of the website, platform, or services
- Your violation of these Terms
- Your violation of law
- Your uploaded data or content
- Your investor communications
- Your business decisions
- Your reliance on platform outputs
- Your misuse of AI-generated content
21. Termination
We may suspend or terminate your access if:
- You violate these Terms
- Payment fails
- You misuse the platform
- You create security, legal, or operational risk
- Continued access would harm Peak Operator, other customers, or third parties
Termination does not relieve you of payment obligations incurred before termination.
22. Changes to These Terms
We may update these Terms from time to time. When we make changes, we may update the effective date above.
Continued use of the website, platform, or services after changes are posted means you accept the updated Terms.
